Welcome to Bushido Performance! The terms "we", "us" and "our" refer to Bushido Performance Inc. ("Bushido Performance"). Bushido Performance operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Bushido Performance is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Bushido Performance reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Bushido Performance confirms acceptance. We must receive and process your payment before your order is accepted. Our acceptance of an order does not extend the shipment time stated in our Shipping Policy, which runs from when we receive your properly completed order as required by 16 C.F.R. Part 435. Please review your order carefully before submitting, as Bushido Performance may be unable to accommodate cancellation requests after an order is accepted, except as provided in our Shipping Policy and as otherwise required by law. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
Products in our heavy-duty truck catalog are commercial goods intended for installation on medium- and heavy-duty commercial vehicles by qualified persons. For those products you represent and warrant that your purchase is for commercial or business use and not for personal, family, or household purposes.
Products in our specialty and imported-vehicle catalog may be purchased for either personal or commercial use.
Our limited warranty covers products Bushido Performance manufactures; products we resell and did not manufacture carry the manufacturer's warranty, if any, as stated in Section 2 of our Limited Warranty & Limitation of Liability policy. Our limited warranty runs to the original purchaser only and is not transferable. If you resell or export a product, that warranty does not pass to your customer, and you are responsible for compliance with all export control, customs, and destination-country requirements that apply to the shipment. Volume and fleet pricing is available and does not require a written agreement; wholesale and distribution terms are available separately on request.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.
Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

SECTION 5 - SHIPPING AND DELIVERY
Except as provided in our Shipping Policy and as required by applicable law, including 16 C.F.R. Part 435, we are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. Nothing in this Section limits your right under our Shipping Policy to a revised shipping date, to cancel, or to a refund where we cannot ship your order within the time stated. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you. Nothing in this Section limits our commitments under our Shipping Policy to file and pursue carrier claims on your behalf and to open a trace investigation on a package that does not arrive.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, video, and audio, and the design, selection, and arrangement thereof, are owned by Bushido Performance, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws. Customer reviews and other content submitted by you remain the property of the person who submitted them; we rely on the license granted in these Terms and claim no ownership of your review.
These Terms permit you to use the Services for your own internal business or personal use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Bushido Performance, Shopify or any third party. Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Bushido Performance.
Bushido Performance's names, logos, product and service names, designs, and slogans are trademarks of Bushido Performance or its affiliates or licensors. You must not use such trademarks without the prior written permission of Bushido Performance. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

SECTION 8 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third party sites, you do so at your own risk.
We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Bushido Performance is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Bushido Performance. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Bushido Performance, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Bushido Performance. Nothing in this section releases, limits, or excludes any liability that cannot lawfully be released, limited, or excluded, including liability for personal injury or death.

SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies. If there is a conflict between these Terms and our Privacy Policy, the Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Review our privacy policy for more details on how we, Shopify, and our partners use your personal information.

SECTION 11 - FEEDBACK
If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, "Feedback"), the license you grant us depends on what you submitted.
If your submission is a customer review of a product or of your experience with us, you grant us only a non-exclusive, perpetual, worldwide, royalty-free license to display, communicate and reproduce that review in full. We will not modify the substance of your review, and we will not sublicense it.
For all other Feedback, including ideas, suggestions, proposals and plans, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including for commercial use. We are and shall be under no obligation (1) to maintain your Feedback in confidence; (2) to pay compensation for your Feedback; or (3) to respond to your Feedback.
We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable on grounds we apply equally to positive and negative reviews, or violates any party's intellectual property or these Terms of Service. We do not remove, withhold, or suppress a customer review because it is negative, and we will not edit a review in a way that changes its substance.
You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive or obscene Feedback, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third-party.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Bushido Performance, Shopify or users of the Services, or expose them to liability.
In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, pretext, spider, crawl, or scrape; or (e) interfere with or circumvent the security features of the Services or any related website, other websites, or the Internet. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.
Nothing in these Terms of Service restricts your right to publish an honest review, complaint, or other honest assessment of our products, services, or conduct. This applies to every part of this agreement, including the representations and warranties you make in Section 11, the prohibited uses listed in this Section 13, the termination and suspension rights in Section 13 and Section 14, and the indemnification obligation in Section 17. We will not treat an honest review or assessment as a breach of these Terms, we will not enforce any provision of these Terms against you on that basis, and we will not impose or threaten any penalty, fee, or legal action, including any claim for costs or attorneys' fees, against you for publishing one.

SECTION 14 - TERMINATION
We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Prohibited Uses, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Waiver of Jury Trial and Class Actions, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

SECTION 15 - DISCLAIMER OF WARRANTIES
The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of any of its contents. This paragraph does not apply to fitment tables, chassis-code lists, year/make/model data, OEM cross-reference numbers or product descriptions published for a product we sell; where a product does not conform to the fitment information published for it, your remedy is stated in Section 5 of our Limited Warranty & Limitation of Liability policy.
EXCEPT AS EXPRESSLY STATED BY Bushido Performance, THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. THIS PARAGRAPH APPLIES TO THE SERVICES AND TO INFORMATION MADE AVAILABLE THROUGH THEM. IT DOES NOT APPLY TO PHYSICAL PRODUCTS. The warranties applicable to physical products, and the treatment of implied warranties on those products, are stated in full in our Limited Warranty & Limitation of Liability policy, which controls over this Section as to products. Nothing in these Terms disclaims any implied warranty on a consumer product where such a disclaimer is prohibited by 15 U.S.C. §2308. SECTION 16 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL Bushido Performance, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

NOTHING IN THIS SECTION LIMITS OR EXCLUDES LIABILITY FOR PERSONAL INJURY OR DEATH CAUSED BY A DEFECTIVE PRODUCT, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED. THE LIMITATIONS IN THIS SECTION APPLY TO ECONOMIC AND PROPERTY CLAIMS ONLY, AND NOTHING IN THIS SECTION LIMITS OR EXCLUDES LIABILITY FOR PERSONAL INJURY OR DEATH, HOWEVER CAUSED. Where a limitation in this Section is held not to apply, our liability for a product is limited to the purchase price actually paid for that product. Nothing in these Terms waives or limits any right or remedy under the Texas Deceptive Trade Practices-Consumer Protection Act or any other provision of law that may not lawfully be waived.

This Section applies to the Services and to information made available through them. It does not reduce or eliminate the remedy stated in our Limited Warranty & Limitation of Liability policy for a defective product, or the refund rights stated in our Shipping Policy and Refund Policy, each of which controls over this Section as to those matters.

SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Bushido Performance, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your acts or omissions in connection with your access to and use of the Services. You have no obligation under this Section for any claim to the extent it arises from a defect in a product we supplied or from our own negligence or misconduct.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

SECTION 18 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 19 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 20 - ASSIGNMENT
You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

SECTION 21 - WAIVER OF JURY TRIAL AND CLASS ACTIONS
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.
EACH PARTY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT PURCHASED FROM US. ANY SUCH ACTION SHALL BE TRIED TO A COURT SITTING WITHOUT A JURY.
EACH PARTY AGREES THAT ANY DISPUTE SHALL BE BROUGHT IN THAT PARTY’S INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Nothing in this section prevents either party from bringing an individual claim in a small claims or justice court of competent jurisdiction, and nothing in this section waives any right that cannot lawfully be waived. Neither party waives any right to a trial by jury, and neither party waives any right to proceed on a class, collective, or representative basis, on a claim for personal injury or death. Nothing in this section waives or limits any right or remedy under the Texas Deceptive Trade Practices-Consumer Protection Act or any other provision of law that may not lawfully be waived.

SECTION 22 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute arising from these Terms shall be brought exclusively in the state courts located in Kaufman County, Texas, or in the United States District Court for the Northern District of Texas, Dallas Division, and you and Bushido Performance consent to venue and personal jurisdiction in those courts. Nothing in this Section limits either party's right, preserved in Section 21, to bring an individual claim in a small claims or justice court of competent jurisdiction.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes. Changes apply only going forward. They do not apply to an order you have already placed, or to any claim that accrued, before the change took effect; those are governed by the version of these Terms in effect at that time.

Shipping Policy

Order Processing

Stocked items are processed and shipped within 1–2 business days (Monday through Friday, excluding federal holidays). Made-to-order and supplier-shipped items ship within the time stated on the product page, and in no case more than thirty (30) days after your order is placed. Orders placed after 3:00 PM Central Time or on weekends and holidays begin processing the following business day. You will receive an order confirmation email immediately after purchase and a second email with tracking information once your order has shipped.

If for any reason we cannot ship any item in your order within the time stated above for that item — for example an item is out of stock or on backorder, or a made-to-order part fails in production — we will contact you by email with a definite revised shipping date — before the original shipping date, and within one business day of our learning of the delay. You can reply to that email to cancel or to accept the new date; it costs you nothing, and you can also write to us at sales@bushidoperformanceinc.com.

If the revised date is thirty (30) days or less after the original shipping date, you may cancel for a full refund of everything you paid, including shipping. If you do not respond, we will treat that as your agreement to the revised date; you may still cancel at any time before the order ships.

If the revised date is more than thirty (30) days after the original shipping date, or if we cannot give a definite revised date, we will cancel your order and refund everything you paid, including shipping, automatically — unless you tell us, before your order ships and within thirty (30) days of the original shipping date, that you accept the delay. Even if you accept, you may still cancel at any time before the order ships and get everything you paid back, including shipping.

If we need to revise the shipping date a second time, we will not ship unless you tell us that you accept the new date. If we do not hear from you before the previously accepted date passes, we will cancel your order and refund everything you paid, including shipping. You may cancel at any time before the order ships.

All cancellation refunds are issued to your original payment method — never as store credit or a voucher. We start the refund within seven (7) working days of the cancellation. If you paid by credit card, the credit will appear on your account within one billing cycle, as provided by 16 C.F.R. §435.2(d)(2); how quickly it posts after we send it is up to your card issuer.

Shipping Methods & Rates

Most orders ship from our facility in Kemp, Texas. Some items are shipped directly by the manufacturer or supplier from that supplier's location. We use UPS, FedEx, USPS, and other carriers depending on package dimensions, weight, origin, and destination. Orders containing both stocked and supplier-shipped items may arrive in more than one shipment, at no extra cost to you. Domestic rates are:

• Economy ground — FREE on orders of $12.00 or more. Estimated 3–5 business days in transit.
• Standard — $14.99. Estimated 2–3 business days in transit.
• Express — $38.99. Estimated 1–2 business days in transit.

Free economy ground is applied automatically at checkout on qualifying orders; no code is required. Standard and Express are optional paid upgrades that you select at checkout — you are never charged for them unless you choose one.

Orders with a subtotal under $12.00 do not qualify for free economy ground. On those orders, Standard ($14.99) or Express ($38.99) will be the available options. The exact shipping charge, if any, is always shown at checkout before you pay.

Standard and Express upgrade transit time only — the processing times stated above still apply.

Shipping charges are non-refundable except where we cannot ship within the stated time and you cancel, where the return is due to our error, or where otherwise required by law.

We do not ship to P.O. Boxes for orders containing large or heavy components. If a P.O. Box is entered for a shipment that cannot be delivered to one, we will contact you for a physical address before shipping.

Delivery Timeframes

Economy ground shipments within the contiguous United States typically arrive within 3–5 business days after the order ships. Actual transit times depend on destination and carrier routing and are not guaranteed. Remote or rural addresses may require additional time.

Delivery timeframes are estimates, not guarantees. Bushido Performance Inc. is not responsible for carrier delays caused by weather, natural disasters, peak shipping periods, or other circumstances outside our control.

Shipment Tracking

Once your order ships you will receive an automated email with your tracking number and a link to the carrier tracking page. Tracking may take up to 24 hours to update after the label is created. If you ordered a stocked item and have not received a shipping confirmation within 3 business days, or a made-to-order or supplier-shipped item and have not received one by the date stated on its product page, check your spam folder and then contact us at the address below.

Damaged or Lost Shipments

We pack every order to travel safely. If your order arrives visibly damaged or short: (1) photograph the outer packaging and the item before fully opening the box, (2) where the carrier presents a delivery receipt, note the damage on it before the driver leaves, and (3) contact us at sales@bushidoperformanceinc.com within 48 hours of delivery. Where we are the shipper of record we will file the carrier claim ourselves; where the item was shipped directly by a supplier, we will open the claim with that supplier on your behalf and follow it through. Either way, if you report the damage or shortage within the time stated below, we will send you a replacement or refund you — we do not make that outcome depend on whether the carrier pays the claim. Failure to report visible damage within 48 hours may limit our ability to file a claim. Damage or a shortage that was not reasonably discoverable on delivery must be reported within five (5) business days after you discover it, and no later than thirty (30) days after delivery — see Section 8 of our Limited Warranty.

If tracking shows your package as delivered but you did not receive it, check with neighbors and other household members first, then contact the carrier directly with your tracking number. If the carrier cannot locate the package, contact us within five (5) business days after you discover the package is missing, and no later than thirty (30) days after the marked delivery date, and we will open a trace investigation.

International Shipping

Bushido Performance Inc. ships internationally to selected countries. We currently ship to Australia, Canada, Hong Kong, Israel, Japan, Malaysia, New Zealand, Singapore, South Korea, and the United Arab Emirates. We do not ship to the European Union or the United Kingdom. International rates are calculated live at checkout by DHL eCommerce based on destination, package weight, and dimensions, and are shown before you pay. Free economy ground applies to domestic orders only.

International transit times are estimates and are not guaranteed. Customs clearance may add time that is outside our control.

The recipient is the importer of record and is responsible for all duties, taxes, tariffs, brokerage, and customs fees assessed by the destination country. These are not included in the price you pay us and are not refundable. If a shipment is refused or abandoned at customs, any refund will be net of shipping charges and any fees we incur.

If your country is not listed, we may still be able to ship to a freight forwarder in the United States that you arrange and pay for; contact us to ask. We cannot ship directly to destinations that are not listed.

FOB Terms

All orders ship FOB Origin. Title and risk of loss transfer to the buyer at the point of shipment, when the carrier takes possession of the goods at our facility or, for items shipped directly by a supplier, at that supplier's facility. Once a shipment is in the carrier’s hands, Bushido Performance Inc. is not liable for loss, damage, or delay caused by the carrier, except as stated under “Damaged or Lost Shipments” above, which sets out what we will do for you and is not limited by this Section. We will file and pursue carrier claims on your behalf; please report damage within the time stated under Damaged or Lost Shipments above so the claim can be filed in time.

Refund Policy

We have a 30-day return policy, which means you have 30 days after receiving your item to request a return. This policy covers change-of-mind returns. It does not limit your rights under our Limited Warranty & Limitation of Liability policy, your right to a refund if we cannot ship your order in time under our Shipping Policy, or any right or remedy you have that cannot lawfully be waived.

To be eligible for a return, your item must be unused, uninstalled, and in its original packaging. You'll also need the receipt or proof of purchase.

To start a return, submit your request in writing to sales@bushidoperformanceinc.com with your original invoice number, item description, and reason for return. Once we approve your return we will email you a Return Authorization (RA) number and the address to send it to. Write the RA number clearly on the outside of the package. Items sent back without first requesting a return will not be accepted.

What We Deduct
On a change-of-mind return we refund the price you paid for the item, less the 15% restocking fee. Original shipping is not refunded, and you pay the cost of shipping the item back. If your order shipped under free economy ground, nothing is deducted for the original shipping — you simply are not refunded a charge you never paid. If the return is because of our error, or the item is defective or incorrect, none of these deductions apply and we refund everything you paid, including shipping.

Restocking Fee
Non-defective returns may be subject to a 15% restocking fee. Return shipping costs are the responsibility of the buyer unless the return is due to an error by Bushido Performance Inc.

Damages and Issues
Inspect your order as soon as it arrives and tell us at once if something is wrong. Report damage, a shortage, or a wrong item that is apparent on delivery within 48 hours of delivery. If the carrier presents a delivery receipt, note the damage on it before the driver leaves — signing a clean receipt certifies the goods arrived in apparently good condition. Report damage or a shortage you could not reasonably have seen on delivery within five (5) business days after you discover it, and no later than thirty (30) days after delivery. Report a defect within thirty (30) days after you discover the condition, and within the warranty period. The full procedure is in our Shipping Policy and in Sections 7 and 8 of our Limited Warranty & Limitation of Liability policy — Section 7 for defects, Section 8 for freight damage. Section 7 also requires you to keep the part as removed until we have had a chance to inspect it. Defective or incorrect items are not subject to the restocking fee.

Non-Returnable Items
The following cannot be returned:

• Custom fabricated parts and special orders. “Custom fabricated parts” means parts produced to specifications or dimensions supplied by the buyer, and “special orders” means items sourced at your request that we do not stock. Standard catalog parts are returnable under this policy whether or not they are produced to order.
• Clearance products. “Clearance” means items identified as clearance on the product page at the time you place your order. An item is not clearance unless it was labeled as such when you bought it.
• Items that have been installed or used

These exclusions apply to change-of-mind returns only. They do not affect your rights under our Limited Warranty, or any right you have that cannot lawfully be waived.

Exchanges
To exchange an item, return the original and place a separate order once the return is accepted. An exchange is treated as a change-of-mind return, so the restocking fee and return shipping above apply, and the replacement is charged at the current price. If the original was defective or incorrect, none of that applies.

Refunds
We will inspect your return within 5 business days of receiving it and let you know the outcome. If approved, your refund will be issued to your original payment method within 10 business days. If more than 10 business days have passed since approval, contact us at sales@bushidoperformanceinc.com. If you cancel an order because we could not ship it within the time stated in our Shipping Policy, we will refund everything you paid, including shipping, within seven (7) working days.

Warranty
Bushido Performance Inc. warrants the products it manufactures against defects in materials and workmanship for the periods stated in our Limited Warranty. Products we resell and did not manufacture carry the manufacturer's warranty, if any, which we pass through to you. The full terms of that warranty — including the exclusive remedy and the exclusion of labor, downtime, towing, and vehicle damage — are set out in our Limited Warranty & Limitation of Liability policy. The remedy that follows applies only to warranty claims on products we have delivered. It does not apply to a 30-day return or to an order you cancel because we could not ship it in time; both of those are refunded to your original payment method. Approved warranty claims are resolved through replacement, credit, or refund at Bushido Performance Inc.’s option among those remedies, which is the buyer's sole and exclusive remedy. No product may be returned without a Return Authorization (RA) number.

LIMITED WARRANTY & LIMITATION OF LIABILITY

Effective 2026-08-15. Applies to products purchased directly from Bushido Performance Inc. This is a Limited Warranty. It is not a full warranty. Its terms, conditions, and exclusions are stated below.
ANY IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED IN DURATION TO NINETY (90) DAYS FROM DELIVERY. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you. See Section 12.

1. Commercial Sale

Products in our heavy-duty truck catalog are commercial goods intended for installation on medium- and heavy-duty commercial vehicles by qualified persons, and are not sold for personal, family, or household purposes. By placing an order for those products, Buyer represents that they are purchased for commercial or business use. Products in our specialty and imported-vehicle catalog may be purchased for either personal or commercial use.

2. Limited Warranty

Bushido Performance Inc. ("Bushido") warrants to the original purchaser that its products will be free from defects in materials and workmanship, when installed and operated under normal conditions in the application for which the part is listed, as follows:

• Structural integrity — cracking, fracture, delamination, or failure at a fastener point: ninety (90) days from the date of delivery.
• Finish and coating — ninety (90) days from the date of delivery.
• Fit — until the part is painted, coated, cut, drilled, modified, or installed, whichever occurs first. See Section 4.

This warranty runs to the original purchaser only and is not transferable.

This warranty applies to products manufactured by Bushido. Products that Bushido resells and did not manufacture are covered by the warranty, if any, of the manufacturer of those products, which Bushido passes through to Buyer to the extent it is transferable. Nothing in this warranty limits, replaces, or enlarges any warranty offered by a third-party manufacturer. Products Bushido did not manufacture are identified as such on their product page. If you believe a resold product is defective, start the claim with us using the procedure in Section 7 and we will tell you the manufacturer, the warranty term that applies, and whether we or the manufacturer will handle it.

3. Installation

Bushido recommends that these products be installed by a qualified heavy-duty truck body shop or technician with the tools, knowledge, and experience necessary to perform the work. Installation must follow all applicable OEM torque specifications, fastener requirements, and mounting points.

This warranty does not cover any product that has been:

• installed other than in accordance with our written instructions or applicable OEM specifications;
• used in an application other than the one for which the part is listed, or otherwise misapplied;
• modified, drilled, cut, heated, re-formed, or altered, except as expressly permitted by the installation instructions;
• subjected to accident, collision, overload, abuse, neglect, road debris impact, or continued operation after a defect became apparent;
• worn out through normal use, or corroded through ordinary environmental exposure.

The requirement to use a qualified heavy-duty truck body shop or technician is a recommendation, not a condition of this warranty, and installing a specialty or imported-vehicle product yourself does not by itself void it. The exclusions above apply to how the product was installed and used, not to who performed the work.

Bushido is not responsible for the acts or omissions of any installer, technician, or repair facility.

4. Test Fit Before Painting or Installing

Buyer must dry test-fit every part on the actual vehicle before any drilling, cutting, sanding, prep, primer, paint, or permanent fastening.

A part that has been painted, coated, cut, drilled, modified, or installed is deemed accepted as to fit and finish, and is not returnable. Claims regarding fit are outside this warranty once any of those steps has been taken. This Section 4 states requirements of the limited warranty in Section 2 only. It does not limit any implied warranty, or any right or remedy, that cannot lawfully be limited.

Minor adjustment — elongating a mounting hole, adding a shim, minor trimming — may be necessary and is normal for aftermarket body and structural components. It is not a defect.

Surface characteristics inherent to the manufacturing process, including minor scratches, tool marks, small dents, flow lines, and cosmetic variation in coating, are normal and are not considered defects.

5. Fitment Data, Descriptions and Catalog Information

Fitment tables, chassis-code lists, year/make/model data, OEM cross-reference numbers, product descriptions, photographs, drawings, and samples are provided for the sole purpose of identifying the product and indicating the vehicles and OEM parts with which it is designed to be compatible.

Fitment information is provided as a guide. Vehicle configurations vary, and Buyer must verify fitment before painting, cutting, drilling, modifying, or installing the product. Where a product does not conform to the fitment information published for it, Buyer's remedy is replacement, credit, or refund under Section 9, and Bushido is not liable for labor, downtime, or other costs excluded by Sections 10 and 11.

Vehicle configurations vary by build date, trim, market, and prior repair history. Buyer is solely responsible for verifying fitment before installation, including by comparing the product against the part being replaced and confirming the OEM part number on the vehicle.

6. Aftermarket Parts — Non-Affiliation

Bushido Performance Inc. manufactures certain products in its catalog and resells others manufactured by third parties. Bushido is an independent manufacturer and supplier of aftermarket replacement parts. Bushido is not affiliated with, endorsed by, sponsored by, or authorized by Kenworth, Peterbilt, PACCAR, Freightliner, Daimler Truck, Volvo, Mack, Navistar, Mitsubishi, or any other vehicle or original equipment manufacturer.

All manufacturer names, model names, part numbers, and trademarks appearing on this site are the property of their respective owners and are used solely for identification and compatibility reference. No affiliation, sponsorship, or endorsement is inferred or implied. Our parts are not OE parts; they are replacement parts for use in equipment of various manufacturers.

7. How to Make a Claim

No product may be returned without a Return Authorization (RA) number. Write the RA number clearly on the outside of the package. Returns received without one may be refused or delayed.

Email sales@bushidoperformanceinc.com within the warranty period with:

1. the original order or invoice number;
2. the complaint — the symptom or condition that led to the inspection ("fairing panel loose at highway speed," "cracking at the upper mounting point"). Descriptions consisting only of "bad," "faulty," or "failed" cannot be processed;
3. the cause — the physical condition of the part on inspection (cracked, fractured, elongated hole, fastener pulled through);
4. the correction — the repair performed or required;
5. photographs of the part as installed and after removal;
6. installation records, where available.

Bushido may require the part to be returned, freight prepaid, for inspection before a claim is approved, and will reimburse return freight on approved claims. We will give you the return address together with your RA number. On an approved claim we also pay the freight to send the replacement part to you. Parts under consideration for a claim must not be destroyed, discarded, or repaired before authorization. Inspection may be destructive. Bushido will notify Buyer before any destructive testing and will give Buyer a reasonable opportunity to document the product beforehand. Final determination of whether a product is defective rests in the reasonable discretion of Bushido, which may require verification by its own inspection notwithstanding any report from Buyer's mechanic or shop.

Prompt notice and preservation of the product are required. Buyer must notify Bushido in writing within thirty (30) days after discovering a condition believed to be a defect, and in any event within the applicable warranty period. Until Bushido has had a reasonable opportunity to inspect, Buyer must preserve the product in its as-removed condition and must not alter, repair, discard, or return it to service, and must preserve the mounting points and surrounding installation to the extent reasonably practicable. Where these requirements are not met and Bushido’s ability to evaluate the claim is materially prejudiced as a result, the claim may be denied. This Section 7 states requirements of the limited warranty in Section 2 only. It does not limit any implied warranty, or any right or remedy, that cannot lawfully be limited.

8. Freight Damage

Inspect every shipment on arrival, whether or not the part will be installed immediately. If the outer packaging shows damage, open the box and inspect the contents, and, where the carrier presents a delivery receipt, note the damage on it before the driver leaves. Where you sign a delivery receipt without noting damage, you certify that the goods were received in apparently good condition. Many parcel shipments are left without a signature and without any delivery receipt; where that happens, photograph the packaging and the item and report within the time stated below, and no receipt is required. If you ship to an address other than your own, you must instruct the recipient to inspect on delivery.

Damage and shortages that are apparent or reasonably discoverable on delivery must be reported to Bushido within forty-eight (48) hours of delivery.

Concealed damage or shortage that was not reasonably discoverable on delivery must be reported to Bushido within five (5) business days after discovery, and in no event later than thirty (30) days after delivery.

Failure to follow the applicable procedure may limit our ability to recover from the carrier and may result in loss of the claim.

9. Exclusive Remedy

IF A PRODUCT IS FOUND TO BE DEFECTIVE, BUSHIDO'S ENTIRE LIABILITY AND BUYER'S SOLE AND EXCLUSIVE REMEDY SHALL BE, AT BUSHIDO'S SOLE OPTION: (A) REPLACEMENT OF THE PRODUCT, (B) ISSUANCE OF CREDIT, OR (C) REFUND OF THE PURCHASE PRICE ACTUALLY PAID FOR THE DEFECTIVE PRODUCT.

THIS SHALL BE BUYER'S SOLE AND EXCLUSIVE REMEDY AGAINST BUSHIDO, WHETHER THE CLAIM ARISES IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE AND NEGLIGENT MANUFACTURE), STRICT LIABILITY, OR UNDER ANY OTHER LEGAL THEORY.

This Section states the remedy for a warranty claim on a product Bushido has delivered. It does not apply to, reduce, or replace: a return under our Refund Policy; a refund owed because we could not ship your order within the time stated in our Shipping Policy, which is always paid to your original payment method and never as credit or a voucher; or any right or remedy under a statute that cannot lawfully be waived or limited, including the Texas Deceptive Trade Practices-Consumer Protection Act.

10. Limitation of Liability

IN NO EVENT SHALL BUSHIDO'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO ANY PRODUCT — WHETHER BASED IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY — EXCEED THE PURCHASE PRICE ACTUALLY PAID BY BUYER FOR THE PRODUCT GIVING RISE TO THE CLAIM. THIS LIMITATION APPLIES EVEN IF ANY REMEDY SET FORTH IN THIS WARRANTY IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

11. Exclusion of Consequential and Incidental Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, BUSHIDO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, PROGRESSIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, ACTUAL OR ALLEGED, ARISING OUT OF OR RELATED TO ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS EXCLUSION INCLUDES, WITHOUT LIMITATION:

• LOSS OF USE OF THE VEHICLE ("DOWNTIME");
• LABOR CHARGES FOR REMOVAL, REINSTALLATION, DIAGNOSIS, PREP, PAINT, OR REFINISHING;
• TOWING, ROADSIDE SERVICE, RECOVERY, OR STORAGE CHARGES;
• DAMAGE TO THE VEHICLE, TO ANY ATTACHED COMPONENT OR TRAILER, OR TO ANY OTHER PROPERTY;
• LOSS OF OR DAMAGE TO CARGO;
• RENTAL OR SUBSTITUTE EQUIPMENT COSTS;
• LOST REVENUE, LOST PROFITS, LOST TIME, OR LOST LOAD;
• FREIGHT, EXPEDITING, AND DIAGNOSTIC CHARGES;
• LODGING, MEALS, AND TRANSPORTATION EXPENSES;
• FINES, CITATIONS, PENALTIES, OR OUT-OF-SERVICE COSTS;
• OR ANY OTHER LOSS ARISING IN CONNECTION WITH THE SALE, USE, OR INABILITY TO USE THE PRODUCT.

THIS EXCLUSION APPLIES EVEN IF ANY REMEDY SET FORTH IN THIS WARRANTY IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

12. Disclaimer of Other Warranties

EXCEPT FOR THE LIMITED WARRANTY EXPRESSLY STATED IN SECTION 2 AND THE FITMENT-CONFORMITY REMEDY STATED IN SECTION 5, BUSHIDO MAKES NO OTHER EXPRESS WARRANTY OF ANY KIND, WHETHER STATUTORY OR OTHERWISE. TO THE EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED IN DURATION TO NINETY (90) DAYS FROM DELIVERY AND IS NOT OTHERWISE DISCLAIMED.

For products purchased for personal, family, or household use, the implied warranties of merchantability and fitness for a particular purpose are not disclaimed and are limited in duration to ninety (90) days from delivery, to the extent permitted by law. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.

The ninety (90) day limit on the duration of implied warranties stated above applies only to products manufactured by Bushido, for which Bushido gives the written warranty in Section 2. Bushido does not limit the duration of any implied warranty on a product it resold and did not manufacture.

No employee, agent, dealer, or representative of Bushido is authorized to make any other warranty, or to assume any other liability, for or on behalf of Bushido. No statement made in a phone call, message, listing, or email creates any warranty beyond the one stated in Section 2.

13. Time Limit on Claims

Any action arising out of or related to any product must be commenced within two (2) years after the cause of action accrues, or it shall be barred. This limit does not apply to any claim under a statute that sets its own limitations period which cannot lawfully be shortened, including the Texas Deceptive Trade Practices-Consumer Protection Act.

14. Governing Law

This warranty is governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute shall be brought exclusively in the state courts located in Kaufman County, Texas, or in the United States District Court for the Northern District of Texas, Dallas Division.

15. Severability and Savings

Some states do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to Buyer. Nothing in this warranty excludes or limits liability to the extent such liability cannot lawfully be excluded or limited. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

Nothing in this warranty waives or limits any right or remedy under the Texas Deceptive Trade Practices-Consumer Protection Act or any other provision of law that may not lawfully be waived.

If any provision of this warranty is held unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Personal Injury

Nothing in this warranty limits or excludes liability for personal injury or death, however caused, or any other liability that cannot lawfully be limited or excluded. The limitations in Sections 9, 10, 11 and 13 apply to economic and property claims only.
